Protected conversations and settlement agreements

We understand that occasionally, there are commercial reasons why you may want to dispense with formal disciplinary procedures.

In such cases you may wish to consider using a settlement agreement and also having what is known as a ‘protected conversation’ with the employee in question in order to make an offer relating to the termination of the employment.

Our employment team can advise in these circumstances and can provide the appropriate documentation so that you comply with the law in this area, such as:

  • Guidance notes for holding the protected conversation;
  • A bespoke script for the protected conversation;
  • An offer letter to the employee; and
  • A Settlement Agreement (previously known as a ’compromise agreement’).

Our aim is to ensure that a ‘clean break’ is achieved, without the risk of subsequent claims.
